TERMS AND CONDITIONS OF THE INTENSIVE COLLECTION ONLINE STORE from 24.09.2018.
The terms used in the Regulations mean:
1. Customer - a natural person, legal person or an organizational unit which is not a legal person, the special provisions of which grant legal capacity, which places Orders within the Store;
2. Consumer - in accordance with art. 22  of the Civil Code means a natural person making a legal transaction with an entrepreneur not directly related to his business or professional activity.
3. Civil Code - the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);
4. Regulations - these Regulations for the provision of electronic services as part of the INTENSIVE COLLECTION online store;
5. Online Store (Store) - the website available at www.intensivecandles.com, through which the Customer may in particular place Orders;
6. Goods - products presented in the Online Store;
7. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between [the entity operating the online store] and the Customer, concluded using the Store's website;
8. Act on consumer rights - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);
9. Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
10. Order - Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Good.
II. General provisions
2.1. These Regulations set out the rules for using the online store available at: www.candleworld.com.pl.
2.2. These Regulations are the regulations referred to in art. 8 of the Act on the provision of electronic services.
2.3. The online store operating at www.intensivecandles.com is run by CW POLAND Sp. z o.o. ul. Tarnowska 23/2 61-323 Poznań NIP PL

2.4. These Regulations specify in particular:
a) the rules for registering and using an account as part of an online store;
b) the terms and conditions for electronic booking of products available as part of the online store;
c) terms and conditions for electronic submission of Orders as part of an online store;
d) the rules for concluding Sales Agreements using services provided as part of the online store.
2.5. Using the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
a) Internet Explorer version 10 or newer or
b) Firefox version 43 or newer,
c) Chrome version 49 or later,
d) Microsoft Edge version 13 or later,
e) Opera version 36 or newer,
f) Safari version 4 or newer.
2.6. In order to use the online store, the Customer should get access to a computer station or end device with Internet access on their own.
2.7. In accordance with applicable law, INTENSIVE COLLECTION reserves the right to limit the provision of services via the Online Store to persons who are at least 18 years old. In this case, potential customers will be notified of the above.
2.8. Customers can access these Regulations at any time via the link on the main page of the website www.intensivecandles.com and download it and print it.
III. Rules for using the Online Store
3.1. The condition for starting to use the Online Store is registration under it.
3.2. Registration takes place by completing and accepting the registration form provided on one of the Store's pages.
3.3. The condition of registration is to agree to the content of the Regulations and provide personal data marked as mandatory.
3.4. INTENSIVE COLLECTION may deprive the Customer of the right to use the Online Store, as well as limit his access to part or all of the resources of the Online Store, with immediate effect, in the event of the Customer's violation of the Regulations, and in particular when the Customer:
a) provided during registration in the Online Store data that is false, inaccurate or outdated, misleading or violating the rights of third parties,
b) has committed, through the Online Store, infringement of personal rights of third parties, in particular the personal rights of other customers of the Online Store,
c) commits other behaviors that will be recognized by INTENSIVE COLLECTION as behaviors that do not comply with applicable law or the general principles of using the Internet or which harm the good name of INTENSIVE COLLECTION.
3.5. A person who has been deprived of the right to use the Online Store may not register again without the prior consent of INTENSIVE COLLECTION.
3.6. In order to ensure the security of the transmission of messages and data in connection with the services provided as part of the Website, the Online Store takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the unauthorized acquisition and modification of personal data sent on the Internet.
3.7. The customer is obliged in particular to:
a) not to provide or transfer content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
b) using the Online Store in a way that does not interfere with its operation, in particular through the use of specific software or devices,
c) not to take actions such as: sending or placing unsolicited commercial information (spam) as part of the Online Store,
d) use the Online Store in a way that is not inconvenient for other customers and for INTENSIVE COLLECTION,
e) use any content posted as part of the Online Store only for personal use,
f) use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.
IV. The procedure of concluding a Sales Agreement
4.1. Information about the Goods provided on the Store's websites, in particular their descriptions, technical and performance parameters as well as prices, constitute an invitation to conclude a contract within the meaning of art. 71 of the Civil Code.
4.2. In order to conclude the Sales Agreement via the Online Store, go to the website www.intensivecandles.com, make a selection of goods, taking further technical steps based on the messages displayed to the Customer and information available on the website.
4.3. The choice of Goods ordered by the Customer is made by adding them to the basket.
4.4. When placing the Order - until you press the button, e.g. "I am ordering with the obligation to pay" or another equivalent button denoting the order with the obligation to pay - the Customer can modify the entered data and selected goods. For this purpose, follow the displayed messages and information available on the website.
4.5. After the Customer using the Online Store has provided all necessary data, a summary of the placed Order will be displayed. The summary of the Order placed will contain information on:
a) the subject of the order,
b) unit and total price of ordered products or services, including delivery costs and additional costs (if any),
c) chosen payment method,
d) the chosen method of delivery,
e) delivery time.
4.6. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "I am ordering with payment obligation" button.
4.7. Sending the Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with INTENSIVE COLLECTION, in accordance with the Regulations.
4.8. After placing the Order, the Customer receives an e-mail message Confirming the Order, containing the final confirmation of all relevant elements of the Order.
4.9. The contract is considered concluded when the Customer receives the e-mail message referred to above.
5.0. The sales contract is concluded in Polish, in accordance with the Regulations.
5.1. Customers can access these Regulations at any time via the link on the main page of the website www.intensivecandles.com and download it and print it.
5.2. Consolidation, security and disclosure of Order data and General Terms and Conditions (online store regulations) takes place via email.
5.1. The delivery of Goods is limited to the area of the Republic of Poland and takes place at the address provided by the Customer when placing the Order.
5.2. Delivery of ordered Goods is done by courier and other forms of delivery - their list is here. Delivery costs can be found here. Delivery costs will also be indicated when placing the Order.
5.3. The delivery deadline is from 1 to 14 business days from the day the Customer sends the Order. The delivery time for some products may be different, especially for custom products (detailed information on the delivery time can be found on the card for each product).
VI. Prices and payment methods
6.1. The prices of the Goods are given in Polish zlotys and contain all components, including VAT (with distinction of the rate), customs duties and all other components.
6.2. The customer has the option of paying the price:
a) by transfer to the bank account number mBank 52 1140 2004 0000 3102 7903 9084,
b) payment in the electronic payment system,
c) cash on delivery,
d) card on delivery.
VII. The right to withdraw from the contract
Only the Customer who is also a Consumer is entitled to an extended 30 day withdrawal period. The consumer has the right to withdraw from this contract within 14 days without giving any reason. The deadline to withdraw from the contract expires after 30 days from the day on which you came into possession of the item or on which a third party other than the carrier and indicated by you came into possession of the item
To exercise the right of withdrawal, you must inform us INTENSIVE COLLECTION ul. Tarnowska 23/2 61-323 Poznań tel. +48 500 453 608 e-mail email@example.com about your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or e-mail).
You can use the model withdrawal form, but it is not mandatory. You can also complete and submit the withdrawal form or any other explicit statement by electronic means on our website Withdrawal from the contract. If you take advantage of this option, we will send you confirmation of receipt of withdrawal information on a durable medium (for example, by e-mail).
To meet the deadline to withdraw from the contract, you only need to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.
Effects of withdrawal from the contract
In the event of withdrawal from this contract, we will refund you all payments received from you, including the costs of delivery (except for additional costs resulting from your chosen delivery method other than the cheapest usual delivery method offered by us), immediately, and in any case not later than 14 days from the day on which we were informed about your decision to exercise the right to withdraw from this contract. Reimbursement will be made using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise; in any case you will not incur any fees in connection with this refund. We may withhold reimbursement until we receive the item or until we receive proof of sending it back, whichever occurs first.
Please send or give us the item to the address INTENSIVE COLLECTION ul. Tarnowska 23/2 61-323 Poznań immediately, and in any case not later than 14 days from the day on which you informed us about withdrawal from this contract. The deadline is met if you send back the item before the 14-day deadline. You will have to bear the direct cost of returning the goods. The amount of these costs is estimated at a maximum of approximately PLN 16. You can also use the Cheap Returns service offered by our Store. You are only responsible for reducing the value of things resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the thing.
VIII. Complaints about the Goods
8.1. CW POLAND SP. Z o.o. as a seller, he is liable to the customer who is a consumer within the meaning of art. 22  of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in art. 556 and art. 556  - 556  and subsequent Civil Code.
8.2. Complaints arising from violation of rights guaranteed by law, or under these Regulations, should be directed to the address firstname.lastname@example.org CW POLAND SP. Z o.o. undertakes to consider each complaint within 14 days. Failure to consider a complaint within the above deadline means that it is justified.
8.3. CW POLAND SP. Z o.o. is not a producer of goods. The manufacturer is responsible for the warranty of the sold Goods on the terms and for the period indicated in the warranty card. If the warranty document provides for this possibility, the Customer may submit his claims under the warranty directly at the authorized service whose address is in the warranty card.
IX. Complaints regarding the provision of electronic services
9.1. CW POLAND SP. Z o.o. undertakes actions to ensure the fully correct operation of the Store, to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any irregularities reported by customers.
9.2. The customer is obliged to immediately notify CW POLAND SP. Z o.o. about any irregularities or interruptions in the functioning of the Online Store website.
9.3. The Customer may report irregularities in writing to the following address: CW POLAND SP. Z O.O., by e-mail to email@example.com or using the contact form.
9.4. In the complaint, the Customer should provide his name, mailing address, type and date of irregularities related to the functioning of the Store.
9.5. CW POLAND SP. Z o.o. undertakes to consider each complaint within 14 days. Failure to consider a complaint within the above deadline means that it is justified.
X. Dispute resolution and final provisions
10.1. The Customer who is a Consumer may, if interested, use extrajudicial means of dealing with complaints and redress. Disputes regarding online purchases can be resolved through mediation proceedings before the Provincial Inspectorates of the Trade Inspection or a trial before the arbitration court at the Provincial Inspectorate of the Trade Inspection. The consumer may also use other methods of out-of-court dispute resolution and e.g. lodge his complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/
10.2. If the Consumer is not interested in the possibility of using out-of-court dispute resolution, settlement of any disputes arising between CW POLAND SP. Z o.o. and the Consumer, will be subject to the courts having jurisdiction in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
10.3. Settlement of any disputes arising between CW POLAND SP. Z o.o. and the Customer who is not also a Consumer will be subject to the court having jurisdiction over the seat of CW POLAND SP. Z O.O ..
10.4. In matters not covered by these Regulations, the provisions of the Civil Code, the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
XI. Information clause in the case of obtaining data from the data subject:
Based on Article. 13 section 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Regulation on the Protection of data) (OJ L 119, p. 1) (hereinafter: GDPR), I would like to inform you that:

Purposes and legal basis for processing personal data
Your personal data will be processed in order to provide services based on [art. 6 clause 1 lit. a GDPR, i.e. your consent to the processing of personal data] for the provision of services in the online store and stationary stores, participation in the loyalty program, direct marketing and order processing, collecting opinions about products in the online store. In order to provide better customer service and better offer matching, the store uses recommending systems whose idea is to profile the customer in the context of his shopping preferences.
Obligation / voluntary provision of personal data
Providing your personal data is voluntary and is a prerequisite for the provision of services and the implementation of the order and participation in the loyalty program, the provision of direct marketing services and the implementation of orders, collecting product reviews, using the Facebook comment system or Google+ login, using chat .
Data processing time
Your personal data will be stored for an indefinite period of time, not less than 5 years from the performance of the order / service / consent to participation in the loyalty program / subscription to the newsletter. An indefinite period of storage of personal data has been established due to the discount policy and the preparation of special offers.
Recipients of personal data
The recipients of your personal data are an accounting office providing services to the data administrator, an online store internet service provider (IAI SA with headquarters in Szczecin, Aleja Piastów 30, 71-064 Szczecin, as the operator of IdoSell Shop) operating under the domain intensivecandles.com , courier service providers (shipping companies), some data may also be transferred to Google Analytics and Facebook and Smartsupp (chat support).
The rights of the data subject

The right to withdraw consent
You can withdraw your consent to the processing of your personal data at any time.
Withdrawing your consent to the processing of personal data does not affect the lawfulness of the processing carried out on the basis of your consent before its withdrawal.
9. Complaint to the supervisory authority
You have the right to lodge a complaint with the supervisory body, i.e. the Inspector General for Personal Data Protection.
Legitimate interests pursued by the administrator or a third party - to properly implement the obligations arising from the contract, including the implementation of orders in the online store and to operate the loyalty program.
There is currently no transfer of personal data to a third country or international organization.
Information about automated decision making, including profiling. The store uses better recommendation systems for better customer service and better matching, the idea is that they profile the customer in the context of his shopping preferences.
In matters not covered by these regulations, the provisions of the Civil Code and relevant acts of Polish law, as well as European Union law, in particular the GDPR, shall apply.
